The Will of RICHARD HEAD COLES, of Ellesborough, Buckinghamshire. Proved 1841 in the Prerogative Court of Canturbury.

In the name of God amen. Richard Head Coles of Ellesborough parish in the County of Buckingham farmer being of weak body but of sound mind and memory and understanding do make publish and ordain this to be my last will and testament in manner following that is to say First I give and devise to my beloved wife Elizabeth Head all and every part and parsell of my estates situated at Ellesborough in the County of Bucks wich I bought of Jonathan Richard of New Street Dorsett Sqr London also all those three cottages wich I now hold under the will of my father John Head of Grendon Underwood Bucks situated at Peasemore in the County of Berks also all my household goods and furniture of every description and all my wareing apparell with all my stock and crops and implements of husbandry now standing lying or being on my farm wich I rent or hold of the Reverend William Henry England during the term of the natural life or marage? wich shall first happen after paying my just debts and funeral expenses but alwais keeping the same insured from los or damage by fire and it is my further will and meaning shall not?xx sell of mortgage any of the above property but alwais keeping the same in good tenatable repair xxx not to be occupied or disturbed but peasably to enjoy the same as long as she shall live I give devise and bequeath immediately after the decease of my beloved wife Elizabeth Head to my eldest daughter Ann Head born of my wife Elizabeth Head at Freelands Farm in the parish of Peasemore in the county of Berks all my dwelling house garding and out buildings theare unto belonging wich I bought of Mr Richard aforsaid to her airs and asines for ever and it is my further will and meaning that she the said Ann Head shall not have it in her power to sel or mortgage or pul down or distroy any part or parsell of the same but if dying without any air then in trust for the airs of ?Pucoy? Elizabeth Head I give to the said Ann Head all that field of arable land with seven houses there on in situated in the parish of Ellesborough in the county of Bucks to her free and xxxxx by her xxx or xxx to be paid to Mr Henry Haten the some of too hundred pounds with is bill for making the convaiance he having no further thain? on the property the money to be paid out of my stock crop of my farm at Ellesborough and I also give and devise to ?pricoy? Elizabeth Head second daughter of me and my said wife born at Freeland in the parish of Peasemore Berks all them three cottages and all out houses and gardings thear unto belonging situate at Peasemore Berks to her airs and asins for ever as a proviso for ther that is to never wanting bread or coming to any parish it is my further will and meaning that they be alwais keep in good tenatable repair and insured from loss or damage fire it the same should be burnt down or destroyed the same to be rebuilt buy the money from the fire I also give to the said ?pricoy? Elizabeth Head the some of five hundred pounds lauful money of Great Britain now out on a mortgage to James Bonnor of Thame for security of the same I hold the deeds of is dwelling hous and garden and buildings the said Eliz Head to be entitled to xxx[intas – interest?] of the above five hundred pne year after her mother’s death but not to be in poss[ess]ion or at liberty to move the mortgage or call the money in providing the said Hames Bonnor regarly pays the inteis for the some the said ?pucoy? Elizabeth Head to take up or call in the said five hundred pounds for her own use no husband having any power but her own art and deed at the age of thirty one years by appling to Mr Sauders Nash of High Wycobe Bucks home I appoint trust of this my last will and testament and if the said ??? Elizabeth Head shall die not leaving any lawful issue the said five hundred pounds with all them three cottages and all thereunto belonging after her death and funeral expenses are paid intrust for the said Ann Head her airs and asines for ever not being allowed to either sel or morgage the same and it is my further will and meaning that all moneys arising from my stock and crops all implements in usbandry and all acts of the same on my above mentioned farm be given to my daugter Ann Head sole executor of this my last will may the same be more or less after paing Mr Henry Atten too hundred pounds with is bill of convaing the same is having no further claim and old Mr Jowerman? if he stil have any claim for her kindness to me during my lifetime I also give to my sister Mary Connon? the wife of John Connon? of Grendon Bucks one deasent suit of mourning to follow me to my last home In testimony that this is my last will and testament set my name the forth day of August one thousand eight hundred and forty Richard Head Coles – James Bonner = John White

Appeared personally Ann Head of the parish of Ellesborough in the County of Buckingham spinster John White of Little Kimble in the same county carpenter and Saunders Nash of Chepping Wycombe in the same county solicitor and severally made oath as follws and first the said John White for himselg made oath that he is one of the subscribing witnesses to the last will and testament of Richard Head Coles otherwise Richard Head late of the parish of Ellesborough aforesaid farmer deceased the said will being now hereunto annexed beginning thus “August 4th 1840 in the name of God amen Richard Head Coles” ending thus “In testimony that this is my last will and testament set my name the forth day of August one thousand eight hundred and forty” and thus subscribed “Richard Head Coles” and having now carefully viewed the said will and particularly observed the interlineation therein to wit the words “sole executor of this my last will” interlined between the sixteenth and seventeenth lines of the fourth page thereof and having also noticed the subscription of the said deceased of himself the deponent and of three other persons as witnesses at the foot of the same page the deponent further made oath that in the month of December last and as the deponent verily believes on the twenty eight day of the said month the said Richard Head Coles otherwise Richard Head set subscribed the name Richard Head Coles on the foot or end of the said will in manner as now appears thereon in the presence of him the deponent and of James Bonnor another of the said subscribing witnesses who were both present at the same time and set and subscribed their names as witnesses to the said will in the presence of the said deceased and as he also verily believes the said writed words were so interlined and the names Thomas Whitchurch and William Jones being the subscribers of the other witnesses before mentioned were written at the foot of the said will previous to such execution and the deponent lastly made oath that immediately after such occasion the said deceased folded the said will and enclosed the same in the envelope hereto annexed marked with the letter A and sealed and endorsed the said envelope in manner as now appears thereon And the said Ann Head for herself made oath that she is the daughter of the said deceased and the sole executrix named in the said will and referring to the subscriptions of Thomas Whitchurch and William Jones as witnesses thereto she further made oath that the said subscriptions were affixed in the presence of the deponent at or about the time the said will bears date to wit in the month of August one thousand eight hundred and forty that the deceased did not a the same time subscribe his name thereto but being afterwards informed of the necessity of signing his name thereto in the presence of witness he executed the said will on the twenty eight day of December last in the presence of James Bonnor and her fellow deponent John White as above deposed to by him the deponent being herself also present at such execution that the said will being enclosed and sealed up as hereinbefore deposed remained so sealed up in the custody of the said deceased until his death which too place on the fourteenth day of May last when the deponent found the same in a chest of drawers in his bed room and in the beginning of the month of July last she took the said will in the state in which she found it to her fellow deponent the said Saunders Nash and the said Saunders Nash for himself made oath that on the said will and envelope being brought to him as aforesaid he opened and perused the same and having now carefully viewed the said will beginning ending and subscribed as aforesaid and having particularly observed the word “insured” written over another word in the twenty fourth line of the first page thereof and the words “shall not not” interlined between the twenty fifth and twenty sixth lines of the same page and the words “sole executor of this my last will” interlined between the sixteenth and seventeenth lines of the last page thereof as aforesaid he further made oath that the said will is now in all respects in the same plight and condition as when opened and perused by him as aforesaid and he lastly made oath that he was the solicitor and confidential adviser of the said deceased in frequent communication with him that the deponent has been informed believes the proper name of the said deceased was Richard Head Coles but that he assumed the name of Richard Head was generally subscribed the said last mentioned name to his letters and to all documents of importance.  Ann Head - John White – Saunders Nash On the 17th day of August 1841 the said Ann Head John White and Sunders Nash were duly sworn to the truth of this affidavit before me Robert J Phillimore Surre Prest Chas J Middleton Not: Pub:

Proved at London 24th August 1841 before the Worshipful Robert Joseph Phillimore Doctor of Laws and Surrogate by the oath of Ann Head spinster the daughter the sole executrix to whom admon was granted having been first sworn duly to administer.
